 WARRANTY POLICY

GB Industries Co., Ltd. (hereinafter called “GB”), subject to the exceptions contained below, warrants new GB Products for a period of 12 months from the date of sale to the first retail purchaser, or for a period of 18 months from the shipping date from GB, whichever period expires first, to be free of defects in material and/or workmanship at the time of delivery. GB’s obligations under this Limited Warranty are limited, at its option, supply free of charge any part or parts found by GB to be defective IN MATERIAL AND/OR WORKMANSHIP. The repair or replacement of parts during the warranty period does not prolong the Warranty time for the Complete Assembly of Machine.

EXCEPTIONS FROM WARRANTY

A. CHISELS: Chisels (rods) are warranted to be free of defects in material or workmanship at the time of delivery. Any exception(s) to this paragraph will be at GB’s option and will only be considered on a ‘GB’s rods warranty guide’

B. NEW PARTS: New parts of piston, cylinder and valve which are obtained individually from GB are warranted, subject to the exceptions herein, to be free of defects in material and/or workmanship for a period of one(1) year after the date of first usage or eighteen (18) months from the shipping date from GB, whichever periods expires first.

C. SPARE PARTS: Spare parts obtained individually from GB are warranted, subject to the exceptions herein, to be free of defects in material and/or workmanship for a period of three (3) months after the date of first usage or six(6) months from the shipping date from GB whichever periods expires first.

D. FREIGHT COSTS FOR PARTS RETURN: Freight costs to return parts to GB, if requested by Soosan, for the purpose of evaluating a warranty claim, are covered under this policy if the claimed part or parts are approved for warranty. Freight costs for any part or parts which are not approved for warranty will be the responsibility of the dealer.

E. RELATED DAMAGES: Damages to parts within a tool which are directly caused by another part or parts which are deemed defective in material and/or workmanship are covered under this policy.

 THIS WARRANTY SHALL NOT COVER THE FOLLOWINGS

A. NORMAL WEAR PARTS: Standard wear parts and maintenance item such as hoses, seals, pins, locking bolts & nuts, wear plates, ring-bushes, front covers, rod pins, etc.

B. ITEMS PRODUCED BY OTHER MANUFACTURES: Components which are not manufactured by GB are warranted by their respective manufacturers.

C. ALTERATIONS & MODIFICATIONS: All obligations under this warranty shall be terminated if the new tool or part is altered or modified in any way.

D. IMPROPER INSTALLATION, MAINTENANCE, REPAIR AND/OR OPERATION: Any failure or performance deficiency attributable to improper installation as per GB specification and / or failure to maintaining, repairing and/ or operating the tool(s) in good condition and procedures as outlined in the GB operation and maintenance manual.

E. STORAGE OR FREIGHT DAMAGE: Damage caused by improper storage or freight handling.

F. LOSS TIME: Loss of operating time to the user while the products is out of service.

G. INCIDENTAL/CONSEQUENTIAL DAMAGES: To the fullest extent permitted by applicable law, in no event will GB be liable for any incidental, consequential or special damages and/or expenses.

H. USE OF NON-GENUINE SPARE PARTS: Parts and or tools not sold by GB, will void all GB warranties.

I. FREIGHT & LABOUR COSTS: Freight costs to obtain parts for the purpose of a warranty repair are not covered by this policy. Delivery terms for the parts is FOB KOREA.

DEALER RESPONSABILITIES

A. WARRANTY REGISTRATION: GB assumes no liability for warranty claims submitted for which no Warranty Registration is on record. In the event a warranty claim is submitted and no Warranty Registration is on record, the request will not be processed without first receiving documentation which proves the sale of the products or the product’s first date of usage. A complete Warranty Registration that is not on file at GB will not be accepted as proof of date of first use.

B. REPORTING PERIOD: Any claim for warranty have to be submitted on a ‘GB Warranty Claim Application Form’ within 30 days from the defect occurrence. Otherwise GB is discharged from the warranty responsibility as far as the defect in question is concerned.

NO ADDITIONAL WARRANTIES OR REPRESENTATIONS

This limited warranty and the obligation of GB thereunder is in lieu of all other warranties, expressed or implied including merchantability or fitness for a particular purpose except for that provided herein. GB does not authorize any other person or company to assume its liability in connection with the sale or use of its products.
